By creating an account, accessing, or using WithYou in any way, you agree to these Terms. If you do not agree, you may not use our service.

2. Description of Service

WithYou provides AI-powered conversational companions designed to offer friendly, supportive interactions. Our service is intended for companionship and conversation, not as a substitute for professional services.

Important: WithYou is NOT therapy, counseling, medical advice, legal advice, or emergency services. Do not use WithYou for mental health crises, medical emergencies, or situations requiring professional intervention.

3. Eligibility

You must be at least 18 years old to use WithYou. By using our service, you represent and warrant that you meet this age requirement.

4. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account
  • You are responsible for all activities that occur under your account
  • You must provide accurate and complete information
  • You must notify us immediately of any unauthorized use
  • We are not liable for losses caused by unauthorized use of your account

5. Acceptable Use

You agree NOT to:

  • Use WithYou for any illegal purpose or in violation of any laws
  • Harass, abuse, threaten, or harm others
  • Impersonate any person or entity
  • Attempt to access, tamper with, or use non-public areas of the service
  • Probe, scan, or test system vulnerabilities
  • Attempt to reverse engineer or extract source code
  • Use automated systems (bots, scrapers) without permission
  • Share sexually explicit, violent, or illegal content
  • Use the service to generate spam or malicious content
  • Violate any applicable laws or regulations

6. Content and Conduct

While conversations are private, we reserve the right to monitor and review content to:

  • Ensure compliance with these Terms
  • Improve our AI models and services
  • Respond to legal requirements or safety concerns
  • Investigate abuse or violations

We may suspend or terminate accounts that violate these Terms without notice or refund.

7. AI Limitations

You acknowledge and agree that:

  • AI companions may make mistakes, provide inaccurate information, or misunderstand context
  • AI responses are generated algorithmically and do not constitute professional advice
  • You should not rely on AI companions for critical decisions
  • AI behavior may be unpredictable and is provided "as is"

8. Payment Terms

Paid features are billed in advance on a recurring basis (monthly or as specified). You authorize us to charge your payment method for applicable fees.

Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours prior to renewal.

Prices may change with notice. Continued use after a price change constitutes acceptance of the new price.

9. Termination

You may terminate your account at any time through account settings or by contacting support.

We may suspend or terminate your access immediately, without prior notice, for any violation of these Terms, illegal activity, or behavior that harms WithYou or other users.

10. Intellectual Property

WithYou and all related content, features, and functionality are owned by us and protected by copyright, trademark, and other laws.

You retain ownership of your input messages. By using WithYou, you grant us a license to use, store, and process your content to provide and improve the service.

11. Disclaimers

WITHYOU IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

  • The service will be uninterrupted, secure, or error-free
  • AI responses will be accurate, complete, or reliable
  • Any defects will be corrected
  • The service meets your requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITHYOU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability shall not exceed the amount you paid us in the 12 months before the event giving rise to liability, or $100, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless WithYou from any claims, damages, losses, or expenses arising from your use of the service, violation of these Terms, or violation of any rights of another person or entity.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms with a new "Last Updated" date. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of IL, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of WithYou shall be subject to the exclusive jurisdiction of the courts located in Tel Aviv/Herzliya, IL.
